What is a post-closing possession agreement?
A post-closing possession agreement lets a seller stay in the home after closing while paying the buyer rent, buying extra time to move without delaying the sale. It gets built into the purchase contract with a per diem rate, a move-out date and a remedy if the seller overstays. Buyers agree to it when they don't need to occupy right away, and because Georgia closings are attorney-conducted, an attorney should review the terms before anyone signs.
